I believe that he was, in fact, a nephew. The son of Emanuel's sister Ann Maria / Mary Ann who does not appear on the IGI for Topsham. This matches up with the birth below and the entry on the 1841 census.Ann Maria has been traced on the 1841-1881 censuses and is shown as the sister of Charlotte Gardner (there was a Charlotte Hooper) and sister to Emaunel's wife (would be sister in law).
